If a child who lives with one biological parent and one stepparent is to be adopted, the other biological parent must therefore give their consent. In the event of a dispute, a family court may grant consent instead. The decisive factor is that the adoption is in the best interests of the child. If the child has reached the age of 14, they must also give their consent. Before their 14th birthday, this is done by their legal representative, for example a parent with custody.<\/p>\n<h3>When adults get adopted<\/h3>\n<p>When adopting adults, the consent of the biological parents is no longer necessary. However, the adoption must be morally justified. In particular, this includes an existing parent-child relationship. There are basically two types of adult adoption. In the case of so-called weak adoption, the family relationship with the biological parents remains intact. These include cases where the family has already adopted or is simultaneously adopting the minor siblings of the now adult child. Alternatively, the adult may have already lived with the family as a minor, but the biological parents did not consent to the adoption. Other possible examples include spouses who adopt their stepchildren, or if the child is not yet of age at the time of application.<\/p>\n<h3>Legal steps for adult adoption<\/h3>\n<p>In order to adopt an adult, the adoptive parents and the adult submit a notarized\u00a0<a href=\"https:\/\/familienportal.de\/familienportal\/lebenslagen\/kinderwunsch-adoption\/adoption\" rel=\"noopener\" target=\"_blank\">adoption application<\/a>. If the prospective adoptive parent is already married or lives in a registered civil partnership, their spouse or registered partner must also give their consent. The application must be accompanied by a number of documents, such as the adoptive parents' marriage certificate and police clearance certificates. In addition, the parties involved and the biological children are interviewed to ensure that a family bond actually exists.<\/p>\n<h3>No difference from biological children<\/h3>\n<p>Through adoption, the adopted child is treated equally to biological and other adopted children in all respects. This applies to both minor and adult adopted children. The court forwards its decision to the registry office and the adoption is automatically entered in the birth register. The adoptive parents or, in the case of adult adoption, the adoptee can now apply for a new birth certificate with a new name. In addition, the birth name is changed to match the name of the adoptive family.
