But what is the difference? The terms are often confused or equated, but these are completely different activities: while notarization is required for significant legal transactions and includes notarial advice, signature certification basically only confirms the identity of the signatory.<\/strong><\/p>\n<p class=\"align-justify\"><strong>Notarization<\/strong><\/p>\n<p class=\"align-justify\">During notarizations, deeds are prepared by the notary and their content is carefully checked. When drawing up the draft, they point out design alternatives and ensure that the notarized legal transaction meets all legal requirements. The deed is also adapted to the wishes and needs of the parties involved. At the notarization appointment, the notary reads the deed to the parties involved and explains its content. They go through the document step by step, e.g. the will, the marriage contract or a purchase agreement for a home. The notary provides neutral advice to all parties involved and gives legal advice. At the end of the notarization, all parties involved and the notary sign the deed. After notarization, notaries implement the deed, i.e. make the necessary applications to courts and authorities on behalf of the parties involved. For example, the notary's office obtains declarations regarding the non-exercise of pre-emptive rights, makes the purchase price due and takes care of all land register entries.<\/p>\n<p class=\"align-justify\">Notarization is required by law for particularly significant legal transactions. It serves to protect citizens, to clarify and inform them about risks and to document the transaction. Notarization ensures that the desired objective is achieved.<\/p>\n<p class=\"align-justify\"><strong>Signature certification<\/strong><\/p>\n<p class=\"align-justify\">A distinction must be made between public notarization: Notaries notarize signatures, for example. They can also create certified copies. When notarizing signatures, the notary only confirms the identity of the person signing. This contributes to security in legal and business transactions and is required by law for important transactions, such as commercial register applications and land register applications. Notaries can also be commissioned to draw up the documents to be signed. The registration of the newly founded association in the register of associations therefore does not have to be formulated by the board itself. In certain cases, e.g. in the case of commercial register applications, the notary also checks whether the registered facts are registrable.
